Rules Governing Use of Roof Facilities Bookings, Procedures, Terms & Conditions

INTRODUCTION

The roof of the building is a shared space that everyone can enjoy. It is a beautiful, well-maintained oasis of wonderful design and nature, located in the middle of one of the world's major cities, where only a very exclusive group of people - residents of 333 - have access. A lovely place to read a book, enjoy a nice meal alfresco, a relaxed conversation, perhaps a short nap in the sun, or to just hang out and admire the beautiful plants and skyline, etc.

 

Please read through the following and indicate your acceptance of these terms by initialing all pages and signing/dating the document at the bottom.

 

USE AS AN INDIVIDUAL PLUS UP TO 5 PEOPLE

       As a resident, you're entitled to free, unlimited use of the roof as an individual.

       If you wish to involve more than 6 people in total, it becomes an “event”. Please refer to the section titled "USE FOR GROUPS OF 6 OR MORE".

  

USE FOR GROUPS OF 6 OR MORE

      You may hold events free of charge on the roof, within reason, provided you have requested permission from the building management, detailing the purpose of the event, the number of attendees you would like, and the proposed duration of the event. Any such event is categorically not approved unless written authorization has been given by management. All such applications should be made to the HOA Management Company.

      You may not charge any attendees to attend your event.

 

BOOKING SPACES OR AREAS

 

      You may book ahead via the Management Company.

Owners may book up to 30 days ahead

Tenants may book up to 15 days ahead

      You can book the dining table for up to 2 hours.

      If it's not on the booking form with the Management company and you have not had a confirmation email, it's not booked.

      With the exception of commercial events authorized by the HOA Board of Directors that contribute directly to HOA funds, events or roof activities cannot be exclusive, i.e. you cannot declare the entire roof off limits to other residents. However, other residents may choose to avoid the roof if they know you have an event booked, so it makes sense to book ahead.

 

GENERAL RULES

      The booking owner/resident of a unit at 333 Grant Ave must be present at the event for the entire duration of the use of the facility. If an owner/resident is not present and his/her guests remain, security will ask them to call the owner/resident back to the roof within 15 minutes. After a further grace period of 15 minutes absence, i.e. 30 minutes after the original request for an owner/resident to appear, any guests that are not accompanied by the owner or resident will be politely asked to leave.

      The HOA Board of Directors reserves the right to close/exclusively reserve the rooftop for the purposes of pursuing commercial opportunities that benefit the entire HOA, in accordance with the purpose of revenue generation opportunities at 333 Grant Avenue. This will not be a frequent occurrence, will not overrule any existing bookings by owner/residents, and shall only occur when the Board of Directors believes there is a compelling commercial case: the revenue from such events increase the HOA's ability to deliver further upgrades and benefits to owners/residents.

      If you are interested in making an arrangement for commercial use of the rooftop for something such as a company social event, photo shoot et cetera, or are aware of a potential opportunity, please contact Action Property Management, the management company, and they will relay details to the HOA Board of Directors.

      No unattended minors/persons under 18 years.

       No pets on the roof at 333 Grant Ave per current building rules. 

       You may not bring any additional appliances or devices (including but not limited to heaters, cookers, fans, barbecues, microwave ovens) without prior written approval from the Management Company. This is for safety and liability reasons; all the roof circuits and systems have been carefully designed with this in mind.

       You may not bring any additional fuels, lighter fluids, igniters, propellants of any kind to the roof, nor use anything other than the gas supply and the grill provided to cook on the roof.

       You are not allowed to toast marshmallows or attempt to cook other food items in or around the fire-pit.

       Do not toss litter or objects or liquids of any kind onto the fire-pit; no paper, no alcohol, no water.

       You may not swap, change, alter or tamper with any fixtures, fittings, sockets, power lines or gas supply hoses for any reason whatsoever.

       All activities on the roof are subject to ordinary laws, including but not limited to:

                        No smoking, per city ordinance

                        No under 21s are permitted to consume alcohol on the premises

       Please inform security guard at the appointed time that you intend to use the facilities and conduct a quick sweep to check cleanliness and tell the guard if you find anything in question.

       Do not lean over or climb on the edge of the roof.

       Do not drop anything of any kind over the edge of the roof.

       Do not leave a mess or personal effects on the roof; otherwise we will need to pay a cleaning fee.

       Use the trash receptacle provided on the rooftop. Do not dump hot ashes into it, or unwrapped sharp objects like discarded knives or broken glass.

       If you make a mess, assess the situation carefully: if you can clean it up without damaging surfaces and finishes, then do so. If you are unsure, please report the matter and have the experts deal with it .

 

MUSIC

       No music is permitted on the roof without a special music permit from the HOA Board.

 These permits will only be granted in highly exceptional circumstances, such as for events that involve the entire building, and even in the case that they are granted they will not permit amplified music of any kind, or any music after 8pm Pacific Time.

 

GENERAL BEHAVIOR

       Drunken or boorish behavior is not acceptable, and owners/residents are also responsible for their guests in this regard. In the event of such behavior, inform security and let them deal with it.

       If you experience any problem, please inform the security guard. If for any reason the security is not available, and you believe that a potential risk of harm exists, then you must rely on sound judgment and act accordingly.

       Politely comply with any reasonable request from the security guard.

       It is your responsibility to turn off any lighting/power/gas/other utilities and services and inform the guard that you have completed the event and left the roof. The guard will perform another sweep to check that all is in order. Failing to inform the guard that you have left the roof could result in being blamed for someone else's subsequent sloppiness, so it's very important to let the guard know you have left.

       Standard rules of reasonable behavior apply at all times;

                        Be respectful to residents, locals and staff.

        

LIABILITY, FINES

       The HOA of 333 Grant Avenue is not responsible for any personal articles left at the roof, or anywhere on the property, irrespective of whether they are lost, damaged, stolen or suffer any other misfortune of any kind. Use of the roof is entirely 'at risk'.

       If any of the rules are broken, a fine of $500 (plus any applicable clean up fees] will be charged. Any fines that go unpaid for more than 30 days will result in that owner/resident losing their privileges to use the roof facilities for a period to be determined by the HOA Board of Directors.

       The booking owner/resident of a unit at 333 Grant Ave is entirely responsible for the conduct and safety of all invitees, in addition to any damage caused by any of them from the time they enter the building to the time they leave.

       The rooftop security camera system has been extensively upgraded, covers all areas, and is for the protection of you and all the owners/residents.

       In the event of any illegal activity, the HOA will cooperate fully with the authorities in identifying the person or persons responsible, and shall at its absolute discretion pursue legal remedy to the fullest extent permissible by the law.

       The HOA Board of Directors reserves the right to change these rules and related fines as necessary.

 

DECLARATION OF COMPLIANCE 

ALL OWNERS AND RESIDENTS MUST SIGN THESE RULES BEFORE THEY ARE GIVEN ROOF USE PRIVILEGES. For the avoidance of doubt, that means owners AND any and all tenants they have.
